Can I start work before the work permit is issued?
In plain termsA work permit (WP) is labour permission. A pending file is not. Treat the planned start date as a legal gate, not a calendar courtesy.
Start here — three checks
- Permission first. Foreign workers generally need a permit or filed exemption (yes).
- Do not borrow the filing window. File between 10 days and 60 days before the planned start.
- Name the start after issue time. Statutory issue is 10 working days on a complete dossier.
Start-vs-wait map
| What HR says | What the clocks actually are | If you start anyway |
|---|---|---|
| “We filed, so you can onboard.” | Filing is not issue. Issue needs the statutory working-day clock. | Work without a permit. Consequence: forced exit or deportation. |
| “The contract is signed, payroll is live.” | Written contract before start is required for employment-contract forms (yes). Still not a permit. | Payroll exists; labour permission does not. |
| “Start Monday; the card comes next week.” | Move the start date past issue, or do not work. | A week of unpaid risk becomes an immigration event. |
| “Exemption will cover the wait.” | Exemption is a separate limb with its own notice. It is not automatic because a permit is slow. | You mix two legal routes in one week. |
Common wrong movesWaiting-room myths that create unlawful work.
- Treating a receipt stamp as permission to enter the office.
- Calling training, shadowing, or “unpaid orientation” non-work.
- Starting on a tourist residue while HR “finishes the paper.”
If the start date is already this weekStop work. Reset the date. Do not backfill.
- Keep the person out of productive work until the permit or a real exemption notice exists.
- Recompute the start using the 10–60 day filing window plus issue time.
- If an exemption limb actually applies, switch to that notice path — do not invent a hybrid.

Common questions
Can I start work in Vietnam while the work permit is still being processed?
No as a default. Foreign workers generally need a work permit or a filed exemption before they work. A pending dossier is not permission.
Does a signed labour contract let me start on Monday if HR filed last week?
For employment-contract work forms, the written contract must exist before the planned start date. That is a filing condition, not a licence to work while the permit is missing.
How early should the employer file?
New-issue filing sits in a window of at least 10 days and at most 60 days before the planned start. Statutory issue time is 10 working days on a complete file — plan the start date after both clocks, not on the filing date.
