Work permit exemption: 3-working-day notification rule

In plain termsEven when NĐ 219 (Decree 219/2025) exempts a foreign worker from holding a permit, the employer must notify labour authorities at least three working days before work starts. Silence is not exemption. HR signing the offer on Friday for a Monday start is how lawful hires become inspection fodder.

Start here — three checks

  1. Confirm the worker fits a named exemption limb — marriage, short stay under 90 cumulative days, intra-group transfer, or other Article 7 case — before skipping permit filing
  2. Calendar three working days backward from the true start date, not from “orientation.
  3. Assign the employer compliance owner to file; the worker does not self-notify

Common wrong movesWhere people lose time on this exact question.
  • Letting the worker sign a personal declaration instead of employer filing.
  • Counting calendar days instead of working days for the three-day window.
  • Filing notice without confirming the underlying exemption limb is real.
If this fails, do this nextRecovery order — not a generic legal memo.
  • Rebuild the start-date calendar with three working days blocked backward.
  • If start already happened, stop work and file immediately with a written explanation — do not stack more days.
  • If cumulative days break the 90-day limb, pivot to full permit planning the same week.
Published gapWhat we do not invent on this page.

NĐ 219 publishes the three-working-day notification window. It does not standardise one national portal screenshot for every province. Keep employer filing proof — receipt, stamp, or logged submission — in the personnel file.

Common questions

Who files the work permit exemption notification in Vietnam?

The employer or sponsoring entity files it. The foreign worker should not treat personal email to HR as filing.

When must the exemption notice be sent?

At least three working days before the planned start date of work.

What breaks most often in practice?

Offer signed early, but legal notice left until the final week and missed because working days were not counted.
