Apartment or land — which product are you actually buying?
In plain termsCommercial project housing is a filed foreign-ownership door. A standalone land-use-rights plot sold “like a local” is not the same statute, and is not filed here as a general product.
Start here — three checks
- Is it project housing? yes
- Read the cap that matches the asset. Apartments 30% per building; landed houses 250 houses per ward-scale area.
- Standalone LUR as a general foreign-individual product? no
Two products, two statutes
| Asset on the listing | Filed door | If you treat them as one |
|---|---|---|
| Project apartment | Housing Law. Building cap 30%. Term 50 years. | You discover the building is already at the foreign cap after you paid a deposit. |
| Project landed house | Still Housing Law. Ward-scale cap 250 houses. | You thought “house” meant freehold land. |
| Bare residential or farm plot from a private seller | Not filed as a general foreign-individual LUR product. | Nominee structures and unenforceable side letters. |
| Marriage-to-VN path | Wider Housing Law rights — still not this page’s land-plot product. | Using marriage as a shortcut to buy raw land without reading Housing Law. |
Common wrong movesListings blur “house” and “land.”
- Paying for “sổ đỏ” language that is not project-housing ownership.
- Using a Vietnamese friend’s name as a silent owner.
- Ignoring the 50-year term because a broker said “renews forever.”
If the listing is not a commercial projectStop. Do not invent a land door.
- Return to the housing hub and test project-housing gates only.
- If marriage to a Vietnamese citizen living in Vietnam applies, read that cell on the hub — it is a different rights set.
- Do not treat company land lease as personal freehold.

Common questions
Can a foreigner buy land in Vietnam the way a Vietnamese citizen can?
A general standalone land-use-rights (LUR) allocation to a foreign individual is not a filed product here. The published ownership door is commercial project housing under the Housing Law.
Is a project apartment the same as owning the land under it?
No. You buy project housing with building and ward-scale caps and a time-limited term. That is not a freehold plot.
What about a landed house in a project?
Landed project houses have their own cap (250 in a ward-scale area) and still sit inside Housing Law, not a general LUR farm/residential plot sale.
