Foreign spouse: first 30 days on a Vietnam path

In plain termsMarriage to a Vietnamese (or to an eligible resident) is a stay path and, under NĐ 219 (Decree 219/2025), can be a work-permit exemption limb. It is not “do nothing.” Month one is: prove the marriage, pick TT (family visa) or the right TRC host, and if you will work, make the employer notify — exemption is not silence.

Start here — three checks

  1. Confirm the marriage is documented in a form Vietnam will accept (legalisation / recognition as required)
  2. If you will work, tell the employer this is an exemption limb that still needs notification — often on a short working-day clock
  3. Do not work on the tourist residue while “the wedding papers are coming.

You will take a job this monthEmployer notification file + identity/marriage exhibits. Skip the full permit only if the limb truly fits.HR files a normal permit late, or files nothing and you work anyway.
You will not work; you are joining a spouseTT visa / family TRC sequence. Do not borrow an employer you will not join.A fake job appears because someone thought TRC required employment.
Spouse’s own sponsor just changed or endedFamily cards can fall with the principal. Map their TRC before you file yours. You attach a family file to a sponsor that is already dying.
Wedding was abroadLegalise and, where needed, record the marriage in Vietnam before labour or TRC desks will use it.A ceremony album is the only exhibit.
You still hold an old LĐ work permit from a previous jobEnd that employment cleanly. Marriage exemption is a new route, not a sticker on the old permit. Two labour stories, one person.
Common wrong movesWhere people lose time on this exact question.
  • Starting the job because “married to a Vietnamese means no permit” and skipping notification.
  • Using a friend’s company as a paper employer to get a TRC you could have obtained as family.
  • Letting the Vietnamese spouse’s expired TRC quietly kill the path you just started.
If this fails, do this nextRecovery order — not a generic legal memo.
  • If already working without notice, stop and file the exemption notification or a permit — today.
  • If marriage documents are not usable yet, do not keep working on the story of the wedding.
  • If the principal spouse lost sponsorship, fix that layer first; your family stay follows.
Evidence to prepareChecklist before you file or walk in.
  • Marriage certificate, legalised/recognised as required, with consistent names.
  • Spouse’s passport/ID and their current Vietnam stay (visa or TRC).
  • Proof of cohabitation or family-file items the local immigration list actually asks for.
  • Your passport, entry stamps, and current visa symbol.
  • If working: employer ERC, draft contract, and the exemption-notification pack.
  • If not working: TT / family TRC forms (NA series as applicable) and sponsor locality.
  • Any previous work permit to be returned.
  • Address lease in a name the family file can use.

Common questions

Can a foreign spouse work in Vietnam without a work permit?

Marriage while living in Vietnam is a named NĐ 219 exemption limb for some cases. It is not automatic silence: the employer still notifies. Confirm you fit the limb before you skip the permit.

What should we do in the first 30 days after arriving as a couple?

Make the marriage usable on paper, pick family stay vs employment stay, and if there is a job, run the exemption notification. Do not mix a tourist stamp with a start date.

Do we still need a TRC?

If you will stay, a family TRC is usually the stay layer. Exemption from a work permit does not issue a residence card by itself.
